This Privacy Policy ("Policy") governs the collection, use, storage, and protection of personal information by Park Pal ("Platform," "we," "us," or "our"), a peer-to-peer parking marketplace connecting property owners ("Hosts") with drivers ("Drivers") seeking to rent parking spaces. By accessing or using the Platform, you consent to the practices described in this Policy. If you do not consent, you must refrain from using the Platform.
Article 1: Scope and Application
1.1 Purpose. This Policy outlines how we collect, process, store, share, and protect your personal information, including personally identifiable information ("PII"), and your rights regarding such information. It applies to all Users, including Hosts, Drivers, and visitors to the Platform.
1.2 Compliance with Laws. We are committed to complying with applicable federal and state privacy laws, including but not limited to the California Consumer Privacy Act (CCPA), to the extent applicable, and other relevant regulations governing data protection.
Article 2: Information Collection
2.1 Types of Information Collected. We collect the following categories of information: (a) Personal Information: Includes names, email addresses, phone numbers, driver's license numbers (Drivers), vehicle registration details, proof of property ownership or control (Hosts, e.g., property deed, utility bill), payment information (e.g., credit card details processed via Stripe), and government-issued identification numbers. (b) Usage Data: Includes location data (e.g., GPS for navigation), booking history, app interactions, IP addresses, device information, and browsing activity. (c) Survey and Form Data: Includes information provided voluntarily through surveys, feedback forms, or demo-related questionnaires. (d) Communication Data: Includes messages exchanged between Hosts and Drivers via the Platform's optional messaging feature.
2.2 Methods of Collection. We collect information: (a) Directly from you when you register, create a listing, book a parking space, or submit forms; (b) Automatically through your use of the Platform (e.g., cookies, analytics tools); and (c) From third-party sources, such as payment processors or identity verification services, to the extent permitted by law.
Article 3: Use of Information
3.1 Purposes of Use. We use your information to: (a) Verify Host and Driver eligibility (e.g., ownership or driver's license validation); (b) Facilitate bookings, payments, and communication between Users; (c) Provide customer support and resolve disputes; (d) Improve the Platform's functionality, security, and user experience; (e) Conduct analytics and research to enhance services; (f) Comply with legal obligations, such as tax reporting or responding to legal requests; and (g) Send transactional communications (e.g., booking confirmations) or, with your consent, promotional materials.
3.2 Legal Basis. We process your information based on: (a) Your consent, as provided through registration or use of the Platform; (b) The necessity to perform our contractual obligations (e.g., facilitating bookings); (c) Compliance with legal obligations; and (d) Our legitimate interest in improving and securing the Platform, provided such interest does not override your rights.
Article 4: Data Sharing and Disclosure
4.1 Third-Party Service Providers. We share your information with: (a) Payment processors (e.g., Stripe) to process transactions securely; (b) Identity verification services to confirm Host ownership or Driver credentials; (c) Analytics providers to improve Platform performance; and (d) Other service providers as necessary to operate the Platform, subject to confidentiality agreements.
4.2 Legal Disclosures. We may disclose your information: (a) To comply with legal obligations, such as responding to subpoenas, court orders, or tax reporting requirements; (b) To protect the rights, property, or safety of the Platform, its Users, or the public; or (c) In connection with a business transaction, such as a merger or acquisition, with appropriate safeguards.
4.3 No Sale of Personal Information. We do not sell your personal information to third parties for monetary consideration. Any sharing is limited to the purposes outlined in this Policy.
Article 5: Data Protection and Security
5.1 Security Measures. 9.1 External Links. The Platform may contain links to third-party websites or services (e.g., payment processors). We are not responsible for the privacy practices or content of such third parties. Review their policies before providing information.
Article 10: International Data Transfers
10.1 Data Location. The Platform operates in the United States, and your information is stored and processed on servers located in the U.S. By using the Platform, you consent to the transfer of your information to the U.S., where data protection laws may differ from those in your jurisdiction.
Article 11: Amendments to Policy
11.1 Updates. We may update this Policy at any time by posting the revised version on the Platform. Continued use constitutes acceptance of the updated Policy. If you do not agree to the changes, you must stop using the Platform.
11.2 Notification of Changes. Significant changes to this Policy will be communicated via email or in-app notification, where feasible, at least 30 days before taking effect.
